Article 1: In order to regulate the services and management of foreigners coming to Hainan without visas, safeguard national security, ensure the free and convenient movement of personnel, and promote the construction of Hainan Free Trade Port, in accordance with relevant laws and regulations such as the "Exit and Entry Administration Law of the People's Republic of China" and the "Regulations on the Entry and Exit of Foreigners of the People's Republic of China", and in light of the actual situation of Hainan Province, this办法 is hereby formulated.
Article 2: Citizens of the country that has been specially approved by the State Council, who enter the country for purposes such as tourism, business, visits, family visits, medical treatment, exhibitions, sports competitions (excluding work and study purposes), with ordinary passports, are exempt from obtaining a visa at the open border ports of this province. During the prescribed period of stay, their activities within the province and related services and management shall be subject to this办法.
Those who are eligible for visa exemption as stipulated in the mutual visa exemption agreement signed with China or who are exempted from visas by China unilaterally shall follow the provisions of such agreements or policies.
The term "foreigners coming to Hainan without a visa" as used in this regulation refers to foreigners who enter the province without obtaining a visa in accordance with the provisions of the first paragraph of this article.
Article 3: The border control for foreigners entering and leaving the island on a visa-free basis shall be carried out in accordance with relevant laws and regulations as well as national provisions.
Port inspection agencies such as customs and border control, as well as enterprises like airports and ports, should optimize the customs clearance environment to facilitate the entry and exit of foreigners who come to Hainan without a visa from within the province.
Article 4: The public security organs of the people's governments at or above the county level are responsible for the stay services and management of foreigners coming to Hainan without a visa.
The tourism and culture, commerce, education, health and wellness, transportation and other relevant departments of the people's governments at or above the county level shall, in accordance with their respective duties, provide relevant services and management for foreigners who come to Hainan visa-free.
Article 5: The governments at all levels and relevant departments of the state shall enhance the publicity of foreign-related laws, regulations and policies, and guide foreigners to abide by the relevant provisions voluntarily.
Article 6: The government service centers and service hotlines established by the people's governments at or above the county level and their relevant departments shall provide necessary foreign language services.
Encourage tourist attractions, hotels, cultural and historical venues, transportation hubs, medical and health institutions, banks and other places to provide necessary translation, consultation, payment, guidance and other convenient services.
Article 7: The governments at or above the county level and their relevant departments shall, in accordance with the law, promptly disclose administrative licensing matters and other administrative management information related to foreigners coming to Hainan visa-free.
Article 8: During their stay in the province, foreign nationals who have obtained visa-free entry to Hainan should abide by Chinese laws and regulations. They must not endanger China's national security, damage public interests, or disrupt public order. Without approval, they are not allowed to travel to other areas within China or stay in the province beyond the visa-free period.
Foreigners who come to Hainan without a visa need to go to other areas within China or stay in the province beyond the visa-free period. In such cases, they must apply to the exit-entry administration department of the public security bureau for a visa document before the expiration of the stay period.
Article 9: The public security department of the provincial government shall, in conjunction with the tourism and culture, commerce, education, health and wellness, transportation, civil aviation, customs, and border inspection departments and units, establish and improve a service information sharing mechanism for foreigners coming to Hainan without a visa.
Article 10: Relevant enterprises such as airports, ports, railway stations, and bus terminals, as well as their staff, shall strengthen the management of identity verification services in accordance with relevant regulations. If during the check-in, security check, ticket verification, etc., they discover that foreigners coming to Hainan without a visa have entered China's territory elsewhere without obtaining visa documents, they shall stop them, inform them to apply for visa documents, and promptly report to the public security authorities.
Article 11: The public security authorities and border inspection agencies should strengthen the management of foreigners entering the island visa-free at airports, ports, railway stations and other transportation hubs, to prevent them from traveling to other areas within China without obtaining visa documents.
The public security authorities should strengthen patrols and security measures at coastal ports (harbors), docks, and shorelines, as well as manage the security of ships and their crew (fishermen), in order to prevent visa-free visitors from coming to Hainan from illegally entering other areas within China.
Article 12: Any acts that violate the provisions of this办法 shall be subject to penalties as prescribed by laws and regulations such as the "Exit and Entry Administration Law of the People's Republic of China".
If the country has other provisions regarding the visa-free policy for foreigners coming to Hainan, those provisions shall prevail.
Article 13 This regulation shall come into effect on September 1, 2024. The "Service and Management Measures for Foreigners Entering Hainan for Tourism Without Visa" (Hainan Provincial Government Decree No. 277) promulgated by the Hainan Provincial Government on April 20, 2018 is hereby abolished simultaneously.
