Several Opinions on Establishing a Sound Mechanism for the Verification and Handling of Business Environment Issues to Further Optimize the Business Environment
In order to thoroughly implement the decisions and plans of the CPC Central Committee and the State Council, establish a sound verification and handling mechanism for business environment issues, accelerate both the surface-level improvement and in-depth optimization of the business environment, and create a world-class, market-oriented, law-based, and internationalized business environment, these Opinions are formulated in accordance with the Regulations on Optimizing the Business Environment of the State Council and the Regulations on Optimizing the Business Environment of Hainan Free Trade Port, taking into account the actual conditions of our province.
1. Establish a Full-Process Closed-Loop Management Mechanism for Business Environment Issues
1.1 Ensure Smooth Channels for Demands. Rely on the 12345 hotline and government service halls to accept inquiries, complaints, and suggestions related to the business environment, and implement online-offline coordinated handling. Deepen the "12345 + Grid + Direct Connection and Joint Handling" mechanism, and establish regular government-enterprise communication mechanisms.
1.2 Implement Classified and Tiered Handling. Implement closed-loop management covering acceptance, distribution, verification, supervision, feedback, and evaluation. Issues that cannot be resolved on the spot shall be transferred within 1 working day. The responsible unit shall designate responsible personnel within 3 working days and report the handling results or progress within 10 working days.
1.3 Standardize Verification and Handling Procedures. Responsible units shall conduct verification based on their duties, following the principles of truthfulness, legality, and impartiality. Methods include on-site inspections, government-enterprise symposiums, and expert seminars. Personnel with a conflict of interest shall recuse themselves.
1.4 Improve Case Closing Standards. The provincial business environment authority, in conjunction with relevant departments, shall determine the standards for case closure. Issues meeting the standards shall be closed; those not meeting the standards shall be continuously supervised. Issues lacking factual or legal basis may be closed with thorough legal explanations.
2. Strengthen Supervision Over Verification and Handling
2.1 Enhance Process Guidance and Supervision. The business environment authority, together with relevant departments, shall strengthen guidance. For units that shirk responsibility or practice fraud, a rectification notice shall be issued. If problems persist, key supervision or responsibility talks may be initiated. Clues of disciplinary or legal violations shall be transferred accordingly.
2.2 Organize Key Verification and Escalated Handling. For major issues that are widely concerning or assigned by higher authorities, key verification shall be conducted. Issues involving cross-regional, cross-departmental, or cross-level coordination may be escalated to the provincial level for handling upon application and approval.
2.3 Integrate the 12345 Platform with the "One Supervision Network" Platform. Achieve data sharing and interconnectivity to form a collaborative supervision force. For reasonable demands that remain unresolved after repeated supervision, they may be pushed to the "One Supervision Network" platform.
3. Innovate Diversified Resolution Mechanisms
3.1 Implement a Leadership Responsibility System. For key and prominent issues, responsible persons from provincial departments and city/county governments shall take the lead in handling them, ensuring efficient and high-quality resolution.
3.2 Establish a Legal Consultation Mechanism for Major and Complex Issues. For major, complex, cross-regional issues, the business environment authority may organize consultations involving legal, industry, and other departments to form solutions in accordance with the law.
3.3 Utilize Dispute Mediation Mechanisms. Adhere to the "Fengqiao Experience" of the new era, prioritize mediation for disputes in the business environment field, and promote the coordinated interaction of people's mediation, administrative mediation, commercial mediation, and judicial mediation.
3.4 Establish a System for Reporting Typical Cases. Report positive cases to play an exemplary role. Expose negative typical cases with serious circumstances and strong public reactions to form a deterrent effect.
3.5 Explore Incentive Mechanisms. Organize business environment award work to encourage innovation. Units and individuals that make outstanding contributions in actively serving business entities may be appropriately encouraged and rewarded.
4. Establish Root Cause Prevention Mechanisms
4.1 Establish a Guidance and Service Mechanism for Lawful Business Operations. Build a comprehensive service mechanism to guide enterprises to operate in compliance with laws and regulations, and enhance the professional capabilities of officials in interpreting and applying laws and policies.
4.2 Enhance Scientific, Democratic, and Law-Based Decision-Making. All cities, counties, and provincial departments shall improve their working mechanisms and refine duty requirements. The principal leader shall assume primary responsibility for the rule of law.
4.3 Establish a Regularized Mechanism for Classified Analysis and Guidance. Use big data and artificial intelligence to monitor and analyze complaint issues, issue early warnings for high-frequency issues, and promote the resolution of "a category of issues" from "a single issue."
5. Safeguard Measures
All cities, counties, and provincial departments shall, based on their actual conditions, earnestly implement these Opinions and establish a working system featuring the leadership of the Party committee, the responsibility of the government, the collaboration of departments, and the guarantee of the rule of law. Each unit's principal leaders are fully responsible for resolving issues in their respective regions and departments. Any leads on corruption or inaction discovered during the verification and handling process shall be transferred to relevant departments for handling in accordance with the law.
